Dinner and a Murder Games End User License Agreement

This End-User License Agreement (“EULA”) is a legal agreement between you and Dinner and a Murder Mystery Games (“DMMG” or “we”) for a Dinner and a Murder Mystery Game product, which includes all code and graphic assets included therein and any future upgrades or updates thereof (collectively referred to herein as “Dinner and a Murder Mystery Game”). Download and/or Use of this product constitutes your agreement to our Game License Agreement.

Terms of Usage

All rights, title, and interest in this Dinner and a Murder Mystery Game Product, including its accompanying user documentation, and all copyrights therein and related trademarks, trade names, and other intellectual property rights, are owned by Dinner and a Murder Mystery Games and are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

 

1. We grant you one license to use this product on a single computer at a time.

2.  You may use the product on another computer, but the product may not be in use on more than one computer at a time unless you purchase additional licenses. You may make backup copies of the product for your personal backup purposes only.

Restrictions

Notwithstanding anything to the contrary contained herein, you are not permitted, under any circumstances:

1. Except as expressly permitted by this EULA or required by applicable law, to download, store, publish, transmit, transfer, sell, rent, lease, sub-license, loan (including but not limited to allowing the Dinner and a Murder Mystery Game to be stored in archival or other searchable databases), exploit for profit or gain, copy, modify, adapt, merge, translate, reverse engineer, decompile, disassemble or create derivative works based upon the whole or any part of the Dinner and a Murder Mystery Game (including but not limited to all or any part of the Dinner and a Murder Mystery Game’s code, art, and graphic assets) or use, reproduce or deal in the Dinner and a Murder Mystery Game or any part thereof in any way or as a part of or as a basis for any material; or

2. To use the Dinner and a Murder Mystery Game to create any product for commercial purposes or otherwise derive financial gain or advantage or compensation of any kind or nature for such use.

Commercial License

1. To use this product commercially you must purchase a Commercial License for each 'for profit' use of this game. No commercial fee is required for non-profit, fundraising, or charity events on the condition they provide a Donation Receipt to DMMG. You may email it to us. Just reply to your purchase receipt and attach the completed form.

2. Non-commercial usage is unlimited for the person who purchased this product for entertainment purposes and the entertainment of others in a recreational fashion.

Limited Warranty

1. We warrant that the product will provide the features and functions generally described in the product specification on our website when you purchased it and in the product documentation. Media on which the Product is furnished, if any, will be free from defects in materials and workmanship.

2. We have taken all reasonable steps to keep the product free of viruses, spyware, "back door" entrances, or any other harmful code. We will not track or collect any information about you, your data, or your use of the product except as you specifically authorize, with the exception of recording the IP, Date, and Time of any downloads of the product. This is for protection purposes only. The product will not download or install patches, upgrades, or any third-party product without your permission. We will not intentionally deprive you of your ability to use any features of the product or access your data.

3. We do not warrant that the product or your ability to use it will be uninterrupted or error-free. To the extent permitted by applicable law, we disclaim any implied warranty of merchantability or fitness for a particular purpose.

Limitations on Liability

Your exclusive remedy under the above-limited warranty shall be, at our option, either a full refund of the purchase price or correction of the defective product or media. To the fullest extent permitted by applicable law, we disclaim all liability for indirect or consequential damages that arise under this license agreement.

General Provisions

 

1. If any part of this agreement is found to be invalid or unenforceable, the remaining terms will stay in effect. This agreement does not prejudice the statutory rights of any party dealing as a consumer.

2. This agreement will be governed by the laws of the USA, including Article 2 of the Uniform Commercial Code, of the state of Tennessee in which we are headquartered. If that state has enacted the Uniform Computer Information Transactions Act (UCITA) or substantially similar law, said statute shall not govern any aspect of this agreement, and instead the law as it existed prior to such enactment shall govern.

3. This agreement does not supersede any express warranties we made to you. Any modification to this agreement must be agreed to in writing by both parties.

Electronic Download Product refund Policy

Due to the nature of digital products, there is no way for us to prevent a customer from using a kit after it has been downloaded to their computer, therefore we do not, under any circumstances, provide refunds on electronic product purchases. We track and record the IP of all purchases, downloads, and download times. If you have not attempted a download, then you are eligible for a refund. If our records reflect a download, then you are not.

We provide a detailed free product preview for you to download and view before purchase. This should enable you to make an informed decision about our games.

Box upgrades are available for only $40 in the event you change your mind and decide on a box.

Boxed and Shipped Product Refund Policy

We will refund your order minus the shipping price we paid and a $5 restocking fee. They must be returned at your expense unused, with everything intact, and postmarked within 7 days of your receipt. If an error is confirmed to be from something we messed up, we will pay return shipping and either refund or ship a replacement or we can discuss another option for you that we both agree on.

Shipping Policy

• We ship products via USPS Priority Mail or UPS Ground for free shipping games, USPS First Class for game money, or another method that you choose.

• Games are printed and leave our office in 2-5 business days. We will notify you if we encounter a problem that will prevent it from leaving within the stated time frame above.

• If you have a party coming up within a week of your order, please text, call, or reply to your purchase receipt and we will do our best to ship it out within 2 business days barring any issues. Without notification from you, we assume you have the time for us to run your order through our normal manufacturing process.

• You will receive a tracking number as soon as we have them printed and labeled. We ship USPS Priority Mail or UPS Ground for orders over $40 FREE within the USA!

Weekends

Weekends are for our home and family. Packages will not leave on the weekend or count toward the shipping time.

BY PURCHASING, DOWNLOADING, OR MAKING USE OF OUR PRODUCTS, YOU AND ANY SUBSEQUENT END-USER ARE AGREEING TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS ABOVE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS AND CONDITIONS, DO NOT PURCHASE, DOWNLOAD OR USE THIS PRODUCT.
